    Never trust anyone from SE Wisconsin. I should know, I'm from there and several of my siblings still live in Calidonia Township (Racine). A strong Progressive community.

        Did your friend get his money back? Do not kid yourself, what the seller has done is fraud (as the condition of the car vs. its description suggests to me the seller knew it was false). While there is a distinction at law between sales puffery--i.e., very clean car, well maintained, ect--which isn't fraud, specific representations of the sort you described that are false and made knowingly or intentionally are fraud.

        So irrespective of whether the parties agreed in writing that the down payment was refundable or not, is beside the point. If your friend does not get 100% of his money back, I would be filing a complaint with the WI Attorney General plus whatever state agency regulates used car dealers. Most/all states have them. Granted, 4% of $1,000 is not a lot of money, but I would at least file complaints with the state regulators. You never know but it could get the rest of the money back.

          I have found it helps to ask the name of the prior owners and call them.
          I was looking at a '66 Big Tank 425hp coupe at a "dealer" in Ohio and asked for the names of prior owners. Well, it turns out one of the owners lost it around a curve, hit a guy wire which cut through not only the A pillar, but also the drivers neck leaving him a little light on top. The thought of his head rolling around in the back area was enough to make me pass.

            Not only should he not be able to keep the 4%, you should be reimbursed for your time and traveling expenses due to his gross misrepresentation. I realize that's not going to happen so you just chalk it up to another dishonest seller and move on.

              Funny you said WWII jeeps.
              A friend of mine had one here in Palm Springs and advertised it as a cream puff with a cream puff price. He would tell every one about the jeep he drives in parades.
              He asked for my help because it sat out and wouldnt start. It was FAR from a cream puff, rust bucket was a better discription.
              I had to pull the head, and grind the rusty valves, replace the trans yoke and seal just to get it drivable.

              The buyer was flying down from Washington to buy it and I could see what was going to happen.

              There were dimond plate strips welded all over the poor jeep and it looked like it was painted while it was going 5 MPH.

              What was so wierd was that he paid a bundle for it himself and really thought it was a cream puff.

              It was just beyond junk and he saw it as a cream puff.

              Not the same case here but there are some that are blind to what they are buying and need some guidance.

              I have gone to many a garage to look at someones treasure only to see that someone did poor work and actually added to the expence of a restoration.

                Yes my friend did get his full down payment back, what gets me is it didn't seem to bother the guy one bit that his lying about the car wasted our whole day plus the money, i could not do that to someone without feeling 1 inch tall. jim

                  I'm glad he at least got all his money back. As Paul S. said above, what you've described sounds like fraud to me, not mere salesman exaggeration.

                    I live in SE Wisconsin. I moved here from San Diego. I've lived in 9 different states over the years. I chose to move here, and other than the weather, I like it. If your statement is tongue-in-cheek, it doesn't come across that way. Either way, I'm not sure what it adds to the conversation other than putting down people.

                        it is truely amazing how deceptive photos are!
                        here is a picture of my son's '66 mustang
                        just before we bought it!!!!

                        (i did go look at it 1st, so knew
                        what i was getting into)

                        in reality, the paint is faded
                        has multiple chips, buldging rusted areas
                        and many duo and triple tone color variations etc.

                            Wife and I drove several hours to look at a car. When we arrived I came to the realization that low resolution pictures can make a sows ear look like a silk purse. That and a lying dealer made for an interesting day. Best one I ever saw was rockers repaired with duct tape and paint. Saved weight I guess.
