        If you want, I say get a lawyer. There is plenty of precedent for the seller having to comply with the contract. This is actually very common with new cars as most stealerships make this same mistake. More often than not, the people who pursue them end up with the car and the dealer taking the loss. I don't see why he would be any different.

        Nevermind the fact that just forgetting to put a reserve is an absolute B.S. copout on this guys part!

        Personally though, if it were me I would forget it, but catch me on the wrong day and I would fight this guy to the death lol.

          If it were me, I'd think I'd inform eBay of the problem and provide the seller with negative feedback AFTER you're pretty sure the sale is not going to come to a satisfactory resolution as far as you're concerned.

          As it stands, you're not really out anything. As far as I know, the seller will be out the eBay commission on the sale because as far as eBay is concerned, the item sold for $50,000. I think he's going to have a hard time convincing them that the commission should be "forgiven" on the basis that he made a mistake in the listing. For an item like this, he should have carefully checked the listing after he listed it and if there was anything wrong he could have canceled and corrected it at that time.

          If he just decided that he didn't want to actually sell the car, so be it. If he actually thinks he can get more money for it, that remains to be seen. To be honest, I would NEVER pay that kind of money for a car I did not personally and carefully inspect or have someone I VERY MUCH trusted carefully inspect---especially a car 54 years old. So, by him canceling the deal, you might be the one with the last laugh.

            this is the new ebay...you should at least contact ebay and inform them that you want to take this further..whats up with there 50,000.00 guarentee seems like this car would fit that bill in some way.This guy does not want to lose his 100 positive and be taken off ebay as a seller or buyer.Just my 2 cents have sold and bought many items on ebay,you won the auction he should have known no reserve means high bidder wins.

              This has been my experience, too.

              PayPal was no help at all.

                And, per the e-bay seller agreement, he has entered into a legal binding contract with you.

                  Forget the car. But I would still get a little satisfaction by complaining to e-bay. Like Jim said, he may have to get a new ID#, but at least I hasselled him a little bit.

                    I have been on the opposite end of that, buyer complaining that what he got was not what he purchased, PayPal sided with the buyer and I got rocks, bolts, nails, etc. This has happened more than one time. Would PP do anything? You are having a dream if you think so.

                      Excellent advice! Even though your ultimate resolution would be via legal means in the appropriate court system, eBay does have 'some' leverage with both buyers and sellers. Their services via the complaint system are free, so why not explore this avenue BEFORE you either leave a negative rating or seek legal consel???

                            So, It looks to me like you take them all, e-bay, pay-pal (same) and the seller to small claims court. At least go after a judgment. Someone in the bunch might get a fire under them to do something. It would be interesting.

                                That may not be worth the trouble. I think the seller is in Iowa and the buyer is in Florida. Pretty sure the small claims case would have to be filed in Iowa.
