I THINK that what Dick is saying is that if a vendor like Corvette Central comes to Carlisle and sells parts, even though the parts are shipped from Michigan to a state outside PA, then they have established a "business presence" in PA. The effect of that may be that, thereafter, they will be expected to collect sales tax on all parts shipped to PA even for orders not taken at Carlisle. In other words, it's like once you START collecting sales tax for the state of PA, you can't STOP collecting it.
As Dick mentions, this wouldn't be a problem for small time vendors since the state would not likely follow up on the matter for them. For big-time vendors like Corvette Central, it could be a different.
Now, if Corvette Central had to thereafter collect sales tax for any parts shipped to PA (even if the order had nothing to do with Carlisle) that might put them at a disadvantage with other vendors that had not established a "sales presence" in PA.
There's one "fly in the ointment" here", though: just about all the major vendors display and take orders at Carlisle. So, I would think this would affect all of them equally and, thus, none would be at a disadvantage with respect to subsequent PA sales. Recently a newspaper, The Denver Post, ran a story about how the IRS is trying to figure out a way to start charging eBay sellers income taxes on whatever profits are gained thru eBay sales. Here is a short paragraph concerning what the Denver Post learned about tax liabilities:
"The IRS's cut
As the economy tightens, eBay and other online sales sites become more attractive venues for unloading unwanted items in return for quick cash. But the IRS is supposed to get its share as well. Here is how you might be affected:
Sales tax is collectible only if you have a sales-tax license. Otherwise, buyers are responsible for paying it to the state and/or city.

I thought the third bullet point down was interesting. "Sales tax is collectible only if you have a sales tax license.
On another note, for those who haven't heard, the IRS is asking the US Congress to pass legislation requireing eBay to start providing information to the IRS about it's sellers. They intend to begin with those who have the designation "Power seller", which you may have noticed besides some eBay seller's user id (name). Ebay is resisting this effort. By the way, in California, the way sales collection works is just as I described above. I don't know, for sure, about PA, but the sales tax practices of many states are the same. In other words, if one state comes up with an idea that helps them collect more sales tax, they all adopt it.
In California, if a business entity has any sort of "business presence" in California, then they have to collect sales tax for ANY sales for items sold in California regardless of how they received the order or where it's shipped from. For example, for years Dell sold computers only via phone or internet orders. Dell is located in Texas and had no warehouses or retail sales outlets in California. So, if Dell took an order from California, they did not have to collect sales tax on that order.
Several years ago, Dell opened a FEW company-owned kiosks in a few malls in California. They were there mainly to demonstrate their products rather than sell units, but they did take orders there. As a result of these kiosks, Dell had to start charging sales tax on ALL order shipped to California, regardless of how they received them.
This same "principle" might apply to vendors at Carlisle. Once they establish a "business presence" in PA, regardless of what duration, they may be obligated to collect sales tax on all orders shipped thereafter to PA. I don't know, for sure, if that's how it works in PA, but I believe it would work that way in CA.In Appreciation of John Hinckley- Top

Unless this is a new law I think it seems odd that all of a sudden this is an issue as this vendor has been coming to Corvettes at Carlisle for years. This should not be viewed as a "black eye" on Carlisle events in particular if it is a Pennsylvania state law. Unless I'm way off base, my guess is that it would be no different in most other states.- Top

Read the C Central comment on the link. If they do continue to come to Carlisle, they will have to charge sales tax on EVERYTHING they ship to PA from the store in MI, not just what they sell at CarlisleDick Whittington- Top

they said some about 10 days in the state so if they spend 3 days at 3 shows that is still only 9 days in my math so they would not have to do the tax thing. they could also just pick their best show $$$$ wise and support that show or shows to stay under the 10 day limit. they are just trying to put lance miller in a spot to get him to go to the Pa govt about their impression of the unfairness of the tax code- Top

its Bill are you going to be at Carlisle this year? i went to GM and it was DEAD. I have bought a few things fom Central and come to think of it they were always shipped. i thought it was because i did not need the part right away and this way they would not run out of stock.

Lots of things change over the years, I won't be at Carlisle for the first time in many years, I remember when Jerry sold parts out of this trunk at early NCRS meets, but time marches on, prices of hotel, fuel, swap meet space, and declining parts inventory makes a breakeven near-impossible, and the tax issue id just another hassle that I've put up with over the years. Time to take a break, although I'll miss seeing old friends, maybe next year...Bill Clupper #618- Top
