need HELP on Virginia Title

    need HELP on Virginia Title

    I have a problem,

    a friend of me Bought a 1990 Jeep wagonneer from ebay more than a month ago (advertised as a ''clear title'' + carfax report etc.....)

    after arrival at the warehouse from my shipper (who will export it to the netherlands). I was notified by them the Title had a lien on it .
    the seller of the car prommissed to arrange a release letter ........ long story short now the seller doesnt respond to email/phone anymore

    now my Q can someone from Virginia give advice or can help me out ?
    the thing is, the Title has been signed by the lien holder for release.
    But the owner of the car forgot to clear the lien from the title at the Dmv.

    would it be possible for a Virginia residence to tranfer this title on his name (see pic)

    to export a car it needs a clear title or a release letter.

    It's been a while since I lived in Virginia, but I don't think the process has changed. I believe that you send the signed original title (with fees) to the VA DMV. In NC where I live now, there is a form on the DMV web site that will release the lein on the title and also transfer ownership to a buyer at the same time. Check the VA DMV web site to see if VA has this type of form. This would take the stupid seller out of the picture. You will need to use this form (or something similar) to transfer the title. The purpose of this bureaucratic exercise is to make sure that you pay the sales taxes, as VA could use the money. The buyer does not have to be a VA resident.

        Sander,

        After the lien was released, the seller should have applied for a new title before he sold the car, but your friend may be able to to clear this up with just the Title he has.

        He needs to completely fill out the bottom part of the Title. He then needs to mail it to the VA DMV with the appropriate fees.

        I strongly suggest that he call the VA DMV (I know, the call is expensive). He should explain his situation and make sure that what I have told you is correct. He will also need to ask them what the Title fee is and how much the taxes are, so he can include a check for that amount. He should also ask them if there is a "quick Title" option, so the Title can be issued immediately and not in three to four weeks.

        And now for the dumb question...are you positive that your shipper understands what he is talking about. The Title clearly shows that the lien was released. This is signed and should be sufficient. If not, could either your friend or the the shipper contact the former lienholder and request a letter stating that the lien was released? With that letter the shipper should not need a new Title.

            I do know about Virginia, but in NC, delivering a vehicle without a marketable title is a felony, by law. He also broke the law by sending you a title signed in blank, meaning he did not insert the buyers name. I am sure that a call or letter to the Virginia Department of Motor Vehicles will get you a quick response from the seller.

              i will ask the shipper to contact dmv to figure out the options
              or try to contact the owner on the title (not the seller) or the lienholder
              i cant find there phone numbers

              abouth the title lien even with the lien holders release it will need an additional release letter for export
              the told me if they would ship they would risk a penalty of 10k
              when customs find out
