I was asked by NCRS President, Mark Tulley to post this email that was sent to the membership this morning.
We had received recommended text of these two policies from our outside accountants which were dutifully filed in the NCRS Policies & Accounting Procedures Manual. We were in compliance with both policies, however they had not been formally adopted by the NCRS Board. This has subsequently been done.
Both the 2020 and 2021 IRS 990 returns have since been amended to correct these two policy answers, and the amended returns accepted without comment by the IRS.
Shannon has taken the fact that NCRS did not have a formally adopted Whistleblower Policy or Document Retention and Destruction Policy (both of which were formally adopted by the Board on January 6, 2023) and mistakenly attached to that lack of policy the criminal penalty (fines and/or up to 20-years in prison) for violating those policies. Neither of these policies is actually required by Sarbanes-Oxley for non-profit organizations like the NCRS, and the criminal penalties only come into play if there are actual violations.
